Why do Will Legacies Fail?
Many people like to leave gifts (known as legacies) in a Will, however these gifts don’t always get to the chosen beneficiary. The most common reasons are:
The item has been given away prior to death;
The item does not meet the description in the Will;
It is in the process of being sold at the time of death;
The beneficiary has died before the testator (person who made the Will);
The gift was left ‘per stirpes’, meaning the gift can pass to the children of the deceased beneficiary
